Commission Regulation (EC) No. 1002/2005 amending Regulation (EC) No. 1239/95 as regards the grant of compulsory licences and the rules on public inspection and access to documents held by the Community Plant Variety Office.

The present Regulation lays down particular amendments to Title II to Regulation (EC) No. 1239/95, which sets out rules governing the proceedings before the Community Plant Variety Office. Chapter IV, which regards the Community licences to be granted by the above-mentioned Office, shall be replaced by the text laid down in this Regulation. The Chapter consists of two Sections. Section 1 concerns compulsory licences pursuant to article 29 of Regulation (EC) No. 2100/94 on Community plant variety rights, whereas Section 2 deals with exploitation rights pursuant to article 100 (2) of the same Regulation.
