Government Decision No. HG446/2025 validating the Regulation on the method and tariffs for calculating the amounts of compensation for damage caused for violations of forestry legislation.

This Government Decision approves the Regulation on the method and tariffs for calculating the amount of compensation for damage caused by violations of forestry legislation. The Regulation applies to infringements committed on forest fund land and other land covered with forest vegetation, irrespective of whether it is state, belonging to local government or privately owned. It establishes that compensation is expressed in conventional units (one unit equals 50 lei) and that damage is calculated for the categories of infringements listed in Article 70(1)(a)–(q) of the Forest Code. Competent environmental and other sectoral authorities are responsible for assessing damage and calculating compensation, which must be paid by natural and legal persons whose acts have caused damage to the forest fund, in accordance with the destinations set in Article 70(3) of the Forest Code. The annexes to the Regulation set out detailed tariffs and calculation rules for specific types of damage. These include illicit felling and serious damage to trees and shrubs (Annex 1), non terminal damage to trees and shrubs (Annex 2), destruction or damage to forest cultures, young stands and natural regeneration (Annex 3), and destruction or damage to seedlings and cuttings in nurseries and plantations (Annex 4). Further annexes regulate unauthorized mowing and grazing and destruction of meadows and pastures on forest lands (Annexes 5–6), unauthorized stripping or destruction of litter, ground vegetation and fertile soil (Annex 7), breaches of forest management rules by forest beneficiaries (Annex 8), unauthorized use of forest lands for construction, resource extraction or other purposes (Annex 9), and unauthorized or out of season harvesting or destruction of plant and animal objects, including species listed in the Red Book and international instruments (Annex 10). Additional tariffs cover destruction or damage of anthills (Annex 11), pollution of forest lands with waste and hazardous substances (Annex 12), destruction or damage of boundary and management markers, information signs, barriers and recreational structures (Annex 13), destruction or damage of drainage systems, roads and engineering works (Annex 14), unauthorized placement of beehives and apiaries (Annex 15), and circulation, parking and fire related damage under Article 70(1)(p)–(q) of the Forest Code (Annex 16). The Regulation provides specific multipliers and correction coefficients depending on forest category (special protection, sanitary recreational, protective and other forests), species (e.g. oak, beech, ash, nut trees, fruit trees, conifers), season (e.g. conifers in November–January), and location (shelterbelts, urban trees, protected natural areas). It also sets rules for determining stump diameter, calculating average diameters where stumps are removed, and establishing lump sum tariffs where entire forested areas are cleared and data are lacking. For certain infringements, compensation is linked to the cost of restoration works, multiplied by fixed factors. The Regulation clarifies that illegally obtained timber and other goods must be returned to the owner or manager, or their market value at the date of finding the infringement must be paid if restitution is impossible. In some cases, payment of compensation does not exempt forest beneficiaries from the obligation to remedy infringements within prescribed deadlines, and repeated compensation may be imposed until full remediation is achieved.
