Energy Financing Act (EnFG).

The Energy Financing Act (EnFG) establishes a comprehensive framework for financing Germany’s electricity-sector energy transition by regulating how renewable energy support, combined heat and power support, and offshore grid connection costs are calculated, allocated, and balanced. It provides for the annual determination of financing needs by transmission system operators, federal compensation of account deficits and recovery of surpluses, and the coverage of certain costs through surcharges on network users. The Act introduces reduced-rate mechanisms for energy-intensive industries, hydrogen production, rail transport, electric buses, and shore-side electricity, subject to defined eligibility, efficiency, and transparency criteria. It sets detailed rules on the calculation, publication, and collection of surcharges, including special provisions for storage facilities, heat pumps, by-product gases, and green hydrogen production, and establishes a special equalisation scheme that caps levies based on specified thresholds and company value added. The Act further imposes extensive accounting, reporting, auditing, and transparency obligations on system operators and beneficiaries, grants supervisory and enforcement powers to the federal regulator.
