Government Resolution No. 1488 validating the Regulation on the procedure for compensating losses caused to indigenous peoples, associations of indigenous peoples and individuals related to indigenous peoples as a result of damage to the original habitat of indigenous peoples by the economic activities of organizations of all forms of ownership, as well as individuals.

This Government Resolution approves a Regulation establishing the procedure for compensating losses suffered by the indigenous peoples, their associations, and individuals belonging to these peoples. The losses arise from damage to their traditional habitat caused by economic activities of organizations of all forms of ownership and by natural persons. The Regulation provides that compensation is to be made on the basis of agreements concluded between economic entities and councils of representatives of indigenous peoples, which are created on a voluntary basis under regional executive authorities to protect the rights and lawful interests of these peoples. One agreement may cover several economic entities operating within a single territory inhabited by indigenous peoples, but for each such territory and economic entity only one agreement may be in force during the period of economic activity. By mutual consent, the agreement may also include provisions on compensation for harm to the person and property of single natural persons belonging to indigenous peoples, the property of their associations, as well as compensation for actual damage and lost profits. The initiative to conclude an agreement may come from either party. Proposals from an economic entity must indicate the person(s) authorized to represent it in preparing and signing the agreement. A draft agreement is prepared by one of the parties by mutual arrangement and may accompany the proposal. For drafting, the parties may engage research and expert organizations, scientists, and specialists. The party initiating the agreement must inform the relevant regional executive authority under which the council of representatives is established. The draft agreement is subject to public discussion in accordance with the law on public control. Following the discussion, the organizer prepares a summary of comments and proposals within ten calendar days and sends it to the parties who are obliged to consider them. The parties then prepare and submit to the regional executive authority a consolidated record of how comments and proposals were taken into account, including decisions and their justification. The council of representatives informs the regional executive authority of the conclusion of the agreement within five days, and the authority publishes the agreement and the consolidated record on its official website on the Internet.
