Law No. 08/L-137 on Forests.

This Law sets out the rules for the management, protection, and use of forest resources. It defines forests broadly to include forest land, vegetation, and associated biological resources, and applies to public and private ownership alike. The Law treats forests as natural assets with ecological, economic, and social functions, and regulates their use in a manner intended to maintain their long-term stability and productivity. It provides for structured forest governance through designated public authorities responsible for planning, administration, and oversight and requires the preparation and implementation of forest management plans based on scientific and technical criteria. These plans determine allowable uses, harvesting levels, and conservation measures, and are binding for both public institutions and private forest owners. The Law establishes measures to prevent and respond to illegal logging, forest fires, pests, and diseases, and regulates activities that may cause environmental degradation. Special attention is given to forests with protective functions, such as those located on erosion-prone terrain or within sensitive ecological zones, where stricter management regimes apply. The use of forest resources, including timber and non-timber products such as fuel wood, plants, and other materials is also regulated. Extraction is subject to permits and must conform to management plans and sustainability principles. The Law also governs the regeneration of forests, requiring reforestation or natural regeneration following harvesting or damage, and supports the restoration of degraded forest areas. Provisions on land use restrict the conversion of forest land to other purposes. Such changes require prior authorization and are subject to conditions, including environmental considerations and compensatory measures. Unauthorized clearing and misuse of forest land are prohibited and subject to penalties, with enforcement carried out by designated inspection authorities. The Law further addresses biodiversity conservation and the maintenance of forest species, promoting the use of ecologically appropriate species and the protection of habitats. It recognizes the environmental functions of forests, including their role in soil and water protection and climate regulation, and integrates these considerations into management and protection measures.
