Government Resolution No. 118 validating the Procedure for the creation of trust funds for drinking water supply and water disposal.

The document defines the legal and organizational framework under which local executive authorities at the regional, city, and district levels may voluntarily establish trust funds for drinking water supply and water disposal. These funds are set up as non-profit legal entities with their own bank accounts, property, and legal capacity, and they operate in accordance with national legislation and their respective charters. The Procedure outlines the permissible sources of financing for the trust funds, which include allocations from national and local budgets, funds provided under state water supply programs, payments from water consumers according to approved tariffs, voluntary contributions from individuals and businesses, grants from development partners, and other lawful sources. The document strictly limits the use of fund resources to activities related to drinking water supply and wastewater systems, such as rehabilitation, reconstruction, construction of new infrastructure, and related design and survey work. Use of funds for unrelated purposes is expressly prohibited. Governance of the trust funds is entrusted to a Fund Council, which manages financial resources based on an annually approved income and expenditure estimate. Council members are appointed by local authorities and may include representatives of water utilities, consumers, contributing legal entities, and civil society organizations. The Procedure establishes requirements for the Council’s first meeting, decision-making processes, transparency, and public oversight, and provides that violations of the Procedure entail liability under the country’s legislation.
