This Law exempts certain interventions on local roads in the State of Santa Catarina from prior environmental licensing. Specifically, it applies to activities such as conservation, maintenance, paving, restoration, and revitalization of existing local roads, provided that such interventions do not involve significant environmental impacts such as vegetation suppression, interference in protected areas, water bodies, or other environmentally sensitive zones (as clarified in the original version and subsequent amendments). The law defines “local roads” as existing local roads of limited technical standard, intended to provide access to small properties or connect nearby settlements. While removing the licensing requirement, the law imposes obligations on the technical responsibility of project executors, requiring them to adopt preventive measures against environmental damage, including erosion, sedimentation, slope instability, and disruption of natural drainage. In case of environmental risks or damages, the responsible party must notify the competent environmental authority and indicate corrective measures. The framework thus seeks to balance administrative simplification with minimum environmental safeguards for the execution of works on local road infrastructure.
