Decree No. 38.140 on the guidelines for the roll-out and implementation of reverse logistics for packaging in general in the State of Maranhão.

This Decree establishes the guidelines for the implementation and operation of a reverse logistics system for packaging waste in the State of Maranhão, in accordance with Brazil’s National Solid Waste Policy. Its primary objective is to ensure that packaging generated after consumer use is collected, recovered, and reinserted into productive cycles through coordinated action by public authorities, businesses, and society. The Decree applies to manufacturers, importers, distributors, traders, and other entities involved in the production and distribution of products that generate packaging waste, and seeks to strengthen environmental protection, resource recovery, and sustainable waste management. It provides the institutional framework for collective and individual reverse logistics models, defines the responsibilities of participating actors, and promotes environmental education and consumer engagement. To achieve these objectives, the Decree requires obligated companies to establish and finance reverse logistics systems independently of municipal waste collection services, either through collective management entities or individual schemes. It promotes the installation of voluntary collection points, the development of recycling and sorting infrastructure, and the integration of waste-picker cooperatives and associations as preferred operators within the system, while ensuring decent working conditions for their members. The Decree also obliges participants to prepare annual Logistics Reverse Plans and performance reports, establish quantitative recovery targets, support recycling cooperatives, conduct public-awareness campaigns, and submit to auditing and verification processes.
