Land (Amendment) Act 2025

The Land (Amendment) Act 2025 amends the Land Act 1996 by introducing provisions for the electronic administration of land matters and by revising rules relating to customary land, compensation, State leases and land management procedures. The Act defines “customary landowners”, “electronic platform”, “fixtures” and “governmental body”, requires specified land transactions, communications, notices, titles and payments to be conducted through an electronic platform, and permits virtual meetings of the Land Board. It transfers certain functions relating to customary land from the National Court to the Local Land Court, amends compensation provisions, including consideration of the future needs of landowners, and allows mediation through the National Court in land disputes. The Act also revises provisions on reservation of land from lease, grant and renewal of State leases, powers of the Minister and the Land Board in relation to leases, special purpose leases, subdivision approvals and appeals, and replaces the provision on disposal of customary land to provide that, subject to the principal Act, customary land cannot be sold and any such sale has no legal effect.
