This Decree establishes the legal framework governing forest restoration obligations in the State of Acre, in accordance with the Brazilian Forest Code. Its principal objective is to ensure that individuals and legal entities that utilise timber or other forest raw materials derived from the authorised clearance of native vegetation compensate for that use through reforestation activities. The Decree defines the persons subject to the obligation, the circumstances in which exemptions apply, and the conditions under which forest replacement must be carried out, with particular emphasis on the restoration of forest cover through the planting of native species and the sustainable management of forest resources. The Decree further establishes detailed mechanisms for compliance, including direct and indirect forest planting schemes, the creation and transfer of forest replacement credits, monitoring and certification procedures, and rules governing the calculation of replacement requirements. It assigns supervisory and enforcement responsibilities to the State Secretariat for the Environment (SEMA) and the Acre Environmental Institute (IMAC), provides for the restoration of degraded areas and the protection of threatened species, and links forest replacement activities to the State’s Ecological and Economic Zoning framework.
