I, JOHN GORMLEY,
Minister for the Environment, Heritage and Local Government, in exercise of
the powers conferred on me by section 3 of the European Communities Act 1972
(No. 27 of 1972), for the purpose of giving further effect to Council
Directive No. 2000/60/EC of 23 October 2000 1 in so far as that Directive relates to the establishment
of programmes of measures and the production of river basin management
plans, hereby make the following Regulations—

Citation
|
|
|
|
1. These Regulations may be
cited as the European Communities (Water Policy) (Amendment) Regulations,
2008.
|
|
|
|
Interpretation
|
|
|
|
2. In these Regulations,
“the Principal Regulations” means the European Communities (Water Policy)
Regulations, 2003 ( S.I. No. 722 of 2003 ) as amended by the European
Communities (Water Policy) (Amendment) Regulations, 2005 (S.I. No. 413 of
2005).

|
|
Amendment of dates
|
|
|
|
3. The Principal Regulations
are amended by the substitution of—
|
|
|
|
(a) “16 October 2009”
for “22 June 2009” in Regulations 12(1), 12(10), 12(11), 13(1), 13(10) and
13(11);
|
|
|
|
(b) “22 December 2008”
for “22 June 2008” in Regulations 12(3)(b) and 14(1)(c);
|
|
|
|
(c) “30 October 2009”
for “22 July 2009” in Regulations 12(11) and 13(11);
|
|
|
|
(d) “16 October 2015”
for “22 June 2015” in Regulations 12(12) and 13(12);
|
|
|
|
(e) “one month” for
“three months” in Regulations 12(4) and 13(5);
|
|
|
|
(f) “by 11 December
2009” for “within five months of the publication of the programme in
accordance with subarticle (1)” in Regulations
12(5) and 13(6);
|
|
|
|
(g) “by 22 December
2009” for “six months after it has been published in accordance with subarticle (1)” in Regulations 12(6) and 13(7).

|
|
|
|
|
|
|

EXPLANATORY NOTE
|
|
|
|
(This note is not part of
the Instrument and does not purport to be a legal interpretation.)

|
The European Communities
(Water Policy) Regulations, 2003 ( S.I. No. 722 of 2003 ) provide for
transposition of the EU Water Framework Directive
2000 (Directive 2000/60/EC). These Regulations amend SI
722 of 2003 by—
|
|
|
|
•amending from 22 June 2008
to 22 December 2008 the deadline for publication of draft programmes of
measures and draft river basin management plans;
|
|
|
|
•amending from 22 June 2009
to 16 October 2009 the deadline for the relevant local authorities to
establish environmental objectives in relation to each river basin district,
establish and publish the programmes of measures, and make and publish river
basin management plans;
|
|
|
|
•amending from 22 July 2009
to 30 October 2009 the deadline for the publication of programmes of
measures and river basin management plans, where the making of such
programmes of measures and river basin management plans have become
executive functions;
|
|
|
|
•amending the date on which
the programmes of measures and the river basin management plans come into
effect from “six months after they have first been published” to 22 December
2009;
|
|
|
|
•amending, from three months
to one month, the period within which the EPA must
provide a report to the Minister in relation to the programmes of measures
and the river basin management plans;
|
|
|
|
•amending to 11 December 2009
the date by which the Minister may, as he considers appropriate, amend a
programme of measures or a river basin management plan by notice issued to
the co-ordinating authority (where previously he could make amendments
within five months of the publication of the programme of measures or river
basin management plan);
|
|
|
|
•amending from 22 June 2015
to 16 October 2015 the deadline for the relevant local authorities to review
and update the programmes of measures and river basin management plans.
