Regulation respecting the prevention of water pollution in livestock operations
Environment Quality Act

This Regulation is replaced by O.C. 742-97, except for any person who stores solid manure originating from a livestock operation referred to in sections 44 to 47 in a storage facility. (See s. 93 of O.C. 742-97, p. 2607)
1. Definitions: In this Regulation, unless the context indicates otherwise, the following terms mean:
(a) «expansion»:
(i) a change made to a livestock operation enlarging the floor area of a building or yard so that the number of animals may be increased, whether of the same type of livestock or of a type of livestock of the same category or of a category of livestock listed lower in the table in Schedule A; or
(ii) a new livestock operation on a lot where such operation already exists or on an adjacent lot belonging to the same operator situated less than 150 metres from the existing operation and intended to house animals of the same type of livestock or of a type of livestock of the same category or of a category of livestock listed lower in the table in Schedule A;
(b) «increase in the number of animal units»:
(i) a change made to a livestock operation that shelters a type of livestock provided for in Schedule A to enable the number of animals of the same type of livestock to be increased without, however, enlarging the area of the floor of the building or of the yard; or
(ii) any increase in the number of animals of the same type of livestock in a livestock operation, without modifications;
(c) «certificate of authorization»: certificate of authorization issued pursuant to section 22 of the Act for a livestock operation or manure storage site;
(d) «yard»: a pen or part of a pen where the livestock density exceeds 5 kilograms of live weight per square metre;
(e) «protected watercourse»: a river or lake identified in the Répertoire toponymique du Québec (1978);
(f) «contaminated water»: water which has been in contact with manure or manure liquid or which contains manure or manure liquid;
(g) «existing»: built or operated not later than 10 June 1981, with or without a certificate of authorization;
(h) «livestock operation»: a building or yard intended for the rearing of cattle, horses, fowl, water fowl, swine, rabbits or fur-bearing animals;
(i) «manure»: excrement or urine mixed or not mixed with each other or with bedding, from a type of livestock referred to in paragraph h;
(j) «liquid manure»: manure that cannot be removed from a storage site with a hydraulic manure fork;
(k) deleted;
(l) «solid manure»: manure that can be removed from a storage site site with a hydraulic manure fork;
(m) «Act»: the Environment Quality Act (R.S.Q., c. Q-2);
(n) «new livestock operation»: a livestock operation built or operated after 10 June 1981, including any change in the type of livestock to a type of livestock of a category listed higher in the table in Schedule A and entailing an increase in the floor space of a building or the size of a yard;
(o) deleted;
(p) «water site»: a well intended or used for consumption by humans or livestock, except a well belonging to the owner of a livestock operation for which application for a certificate of authorization is made, a spring, regulated ditch, watercourse, lake, ocean, gulf, swamp of an area of no less than 10 000 square metres or a pond, except for a water reserve intended exclusively for protection against fire, and except for a protected watercourse;
(q) «change in the type of livestock»: partial or total change in a livestock operation by replacing one type of livestock by another without enlarging the area of the floor of the building or of the yard;
(r) «Minister»: the Minister of the Environment and Wildlife;
(s) «animal unit»: reference unit established in relation to the animal species in a livestock operation, as defined in Schedule B.

DIVISION II
CERTIFICATE OF AUTHORIZATION
2. Required certificate of authorization: No person shall construct or undertake to operate a new livestock operation, expand, change types of livestock or increase the number of animal units, or install or modify a manure storage site without having obtained a certificate of authorization for that purpose from the Minister.

3. Compliance: Before granting a certificate of authorization, the Minister must ensure that the project complies in all respects with the Act and this Regulation.

4. Strict obligation: Any new livestock operation, extension, change in the type of livestock, increase in the number of animal units, or construction or modification of a manure storage site must comply with the data and information provided for the purpose of obtaining a certificate of authorization, with the provisions of any certificate of authorization and with this Regulation.

5. Change: Before being implemented, any change in the date or information submitted for the purpose of obtaining a certificate of authorization must be the subject of a new application for a certificate of authorization.

6. Tenor: Any certificate of authorization must show the name of the person on whose behalf it is issued, its date of issue, the date on which the application for authorization is made, the location and the technical characteristics of the project.
The certificate of authorization must also include, at the end, the following note:
«The above project may be undertaken under this certificate of authorization provided that the project complies with the above data and information. However, it becomes void if the project authorized is not undertaken within 18 months of the date on which this certificate of authorization is issued.»

7. Validity: A certificate of authorization becomes void if the project authorized is not undertaken within 18 months of the date on which it is issued.
A certificate of authorization issued for a livestock operation before 10 June 1981 becomes void if the project authorized is not undertaken before 10 December 1982.

8. Exception: However, the second paragraph of section 6 and section 7 do not apply to certificates of authorization that pertain to the construction or modification of a manure storage site only.

9. Exclusions: Section 22 of the Act and section 2 of this Regulation do not apply to an increase in the number of animal units where such increase does not exceed 25 animal units in relation to the number of animal units in the operation on 10 June 1981 or the number of animal units prescribed in the certificate of authorization, nor do they apply to non-commercial livestock operations having fewer animals than the limits prescribed by the table in Schedule A.
Section 22 of the Act, section 2 and Division III of this Regulation do not apply to rebuilding under section 16, where such rebuilding is carried out within 36 months of the destruction of a building. The same applies where, after an interruption of less than 36 months, a person resumes a livestock operation which, if established after 21 December 1972, has already been issued a certificate of authorization, provided that the same type of livestock or a type of livestock listed lower in the table in Schedule A is raised and that the number of animal units in the operation does not exceed the original number of animal units.
No person shall be granted the exclusion prescribed by the second paragraph where he no longer has a land area for manure spreading similar to what he had before the destruction of the building or the interruption of operation.

DIVISION III
SITING STANDARDS
10. Limited activities: Where, in a municipality listed in Schedule G or H, or in a municipality where the areas necessary for spreading the manures produced there are insufficient considering the ratios mentioned in Schedule F, a project intended
- to undertake to operate a liquid manure livestock operation,
- to expand such an operation,
- to increase the number of animal units forming part of livestock on liquid manure, or
- to change the type of livestock by replacing it with livestock on liquid manure,
has been the subject of a certificate of authorization granted after 27 June 1996, all the liquid manures resulting from the installations or activities thus authorized, as well as, where applicable, all the other liquid manures resulting from the operation to which the above-mentioned certificate pertains and already operated by the person to whom that certificate was issued, shall be disposed of or treated by one of the following methods:
(a) the manure is spread on land owned by the person to whom the above-mentioned certificate of authorization was issued;
(b) a manure management organization approved by the Minister takes charge of the manure; or
(c) the manure is treated as authorized by the Minister under section 22 or 32 of the Act.
The first paragraph does not apply where the person responsible for a livestock operation confines himself to regrouping in the same livestock operation, without increasing the number of animal units, livestock he already raises in other livestock operations within the limits of the same local municipality, provided he ceases to use the latter for raising livestock.

11. New operations: It is forbidden to establish a new livestock operation or to undertake an extension, a change in the type of livestock, an increase in the number of animal units or the construction or modification of a manure storage site pertaining, in all cases, to a new livestock operation:
(a) for a liquid manure livestock operation, less than 300 metres from a well or spring used to supply a waterworks system, or from a water bottling plant, and less than 100 metres from the ordinary high water mark without flooding of a protected watercourse;
(b) for livestock on solid manure: less than 100 metres from the reference points specified in paragraph a;
(c) at a shorter distance than that prescribed in Schedule D, between the new livestock operation or new manure storage site and a water site not specified in paragraph a;
(d) in a flood plain subject to floods at least once every 20 years.

12. Existing operations: Any extension, any change in the type of livestock increase in the number of animal units, any construction or modification of a manure storage site pertaining to an existing livestock operation that does not comply with the sitting standards prescribed in section 11 must be carried out:
(a) more than 75 metres from the reference points specified in paragraph a of section 11, for a liquid manure livestock operation;
(b) more than 30 metres from the reference points specified in paragraph a of section 11, for livestock on solid manure;
(c) at a distance greater than that prescribed in Schedule D between the livestock operation or manure storage site and any water site.
Furthermore, any extension, or any construction or modification of a manure storage site pertaining to an existing operation must be carried out at a distance from the reference points specified in paragraphs a and c of section 11 or beside the livestock operation that is farthest away from those reference points, unless a topographical accident prevents it from doing so, or where these projects comply with the standards prescribed in those paragraphs.
Unless siting standards in section 11 are complied with, no existing livestock operation shall change the type of livestock of a category listed in the table in Schedule A for a type of livestock of a category listed higher in the table if a manure operation is changed from solid manure to liquid manure or to a yard operation, except where the person responsible for the livestock operation making the change owns another livestock operation located less than 150 metres away and housing the desired livestock.
In a livestock operation that does not comply with the siting standards prescribed in the first paragraph one may, however, construct or modify a manure storage site at a distance shorter than the standards prescribed in that paragraph provided that the site is no nearer to the reference points specified in that paragraph than the existing manure pile.

13. Exceptions: For the purposes of applying the siting standards prescribed in sections 11 and 12, a change in the type of livestock, an extension or an increase in the number of animal units must be considered as a new livestock operation wherever the total number of animal units exceed the maximum number prescribed in Schedule A.
The siting standards prescribed in this Division do not apply to a change in the type of livestock of a category listed in the table in Schedule A by a livestock operation of a category listed lower in the table.

14. Shortest distances: The siting standards prescribed in sections 11 and 12 are measured by using the shortest distance between the reference point and the building or yard of the livestock operation or manure storage site. These measurements are based on the part of the building or yard which is actually used for keeping livestock.

15. Extension: For an extension, the siting standards prescribed in sections 11 and 12 are measured by using the shortest distance starting from the extension itself.

16. Rebuilding: If, subsequent to a fortuitous event, a livestock operation originally established under the Act and any applicable regulation is rebuilt but does not comply with the standards prescribed in section 11, the livestock operation must be rebuilt in the same place or at a greater distance from the reference points referred to in this Division.
A livestock operation that has thus been rebuilt must shelter the same type of livestock and a number of animal units that does not exceed that which it contained before it was demolished without, however, prejudice to the right to apply for a certificate of authorization for an extension, a change in the type of livestock, an increase in the number of animal units or a new livestock operation.

DIVISION IV
GENERAL MANURE MANAGEMENT STANDARDS
17. General prohibitions: No one may deposit or discharge or allow the deposit or discharge of manure, manure liquid or contaminated water into the environment except where the said deposit or discharge is carried out in accordance with this Regulation.
This prohibition is established within the meaning of the second paragraph of section 20 of the Act.

18. Tolerance: No one may tolerate manure, manure liquid or contaminated water elsewhere than in the places prescribed for that purpose in accordance with this Regulation.

19. Management system: Any livestock operation must be equipped with a manure management system in accordance with this Regulation, according to the type of manure or operation in question.

20. Floor: The floor of any building of a livestock operation must be watertight except for:
(a) a livestock operation totally or partially on slats where the basement is a watertight manure storage site;
(b) raising on bedding where absorbents are used to retain all manure, liquid manure and contaminated water produced by sheep, goats, castle, horses, fowl, water fowl, rabbits or fur-bearing animals.
The floor of any livestock operation covered by subparagraph b of the first paragraph shall be located above the highest level of the underground water table, in its natural state or artificially lowered by gravitation, and be designed so that runoff cannot reach it.
The manure storage standards prescribed by Division V apply to basements covered by subparagraph a of the first paragraph.

21. Agreements: An agreement for manure storage or disposal that has been entered into between the person responsible for a livestock operation and another person to obtain a certificate of authorization must initially be of a minimum duration of 4 years.
A subsequent agreement must be of a minimum duration of 2 years.
The same land area may not be the subject of more than one agreement at the same time.

22. Spreading: For spreading the manure, the person responsible for a livestock operation must have access to the land areas prescribed in his certificate of authorization or in section 40.

23. Special case: However, sections 21 and 22, and Divisions V and VI do not apply where the manure is treated as authorized by the Minister in accordance with section 22 or 32 of the Act.
The minimum terms of the agreements provided for in section 21 do not apply to agreements entered into with a manure management organization approved by the Minister.

24. Required storage sites: Except in cases covered by subparagraphs a and b of the first paragraph of section 20, a livestock operation shall include a manure storage site designed and located in compliance with Division III and this Division, unless all manure produced is spread directly on the land in compliance with Division VI.

25. Authorized storage sites: Subject to section 35, solid manure from a livestock operation must be stored on a watertight surface that retains manure liquid.
Liquid manure from a livestock operation shall be stored in a watertight holding tank.
The first paragraph does not apply to solid manure from:
(a) a livestock operation with less than 35 animal units; but where such operation is located less than 30 metres from a watercourse, lake or ditch draining more than 3 farm operations, the first paragraph applies; or
(b) a livestock operation with at least 35 but no more than 50 animal units; but where the operation is located less than 150 metres from a watercourse or lake, the first paragraph applies and where the operation is located near a ditch, the following table determines where the storage surface shall be watertight as required by the first paragraph.

A livestock operation with more than 5 hog animal units is not entitled to the exemption prescribed by the third paragraph.
Where several livestock operations are operated by the same person, the exception prescribed by the third paragraph does not apply if such operations are located less than 150 metres apart or if the total number of animal units they house exceeds any limits specified in that paragraph, where applicable.
The person responsible for a livestock operation to which the exception prescribed in the third paragraph is applicable shall avoid any discharge of manure, liquid manure or contaminated water into a protected watercourse, water supply point, ditch, water reserve for fire fighting or the underground water table and take all measures required for that purpose.

26. Water table: Any storage site must be placed above the highest level of the underground water table in its natural state or lowered artificially by gravitation.
This section does not apply to the storage sites provided for in section 12 and situated in a flood plain.

27. Flood plain: A manure storage site that is intended for an existing livestock operation and that is established in a flood plain must be equipped with watertight side walls that are as high as the highest flooding level, or must be surrounded by a watertight dyke of that height.

28. Drain: The person responsible for a manure storage site shall ensure that its entire outer perimeter, at and below floor-level, is equipped with a drain not connected to the site and whose outlet is joined to an inspection cover accessible at all times for the taking of samples.
The person responsible for a storage site shall be able to locate the outlet of the peripheral drain in all seasons; he shall check periodically to ensure that there is no leakage of liquid manure or contaminated water.
This section does not apply to manure storage sites whose construction started on or before 10 June 1981.

30. Capacity: The person responsible for a storage site shall ensure that it is designed to collect all manure and liquid manure produced by his livestock operation and all contaminated water for a minimum period of 200 consecutive days.

31. Overflow and sump drains: No manure storage site may be equipped with an overflow or sump drain that allows manure liquid or contaminated water to run off directly or indirectly into the environment.

32. Protection from runoff: Every manure storage site shall be protected from runoff.
A liquid manure storage site where the highest level of liquid is above grade and which is located less than 5 kilometres upstream from a surface water source supplying a waterworks system shall be surrounded by an earth backfill forming a reservoir with a minimum capacity equal to 1,5 times the capacity of that part of the storage site above grade. This requirement does not apply where a liquid manure storage site is a natural earth reservoir.

33. Flooding: No manure storage site may flood.

34. Manure storage: Subject to section 35, the evacuated manure of a livestock operation where the soil conditions specified in section 42 prevail shall be stored in a storage site prescribed by section 25.

35. Manure pile in a field: In a cultivated field, the person responsible for a livestock operation may pile solid manure from:
(a) any livestock operation using bedding as defined by subparagraph b of the first paragraph of section 20;
(b) any livestock operation, other than an operation covered by subparagraph a, with less than 50 animal units, provided such livestock operation has no more than 5 hog units.
Any pile permitted by the first paragraph shall be located at least 150 metres from any protected watercourse and 75 metres from any water supply point.
It shall be located at least 30 metres from any ditch draining more than 3 farm operations.
The land around the manure pile must be laid out so that it prevents runoff from reaching the pile, and have a slope of less than 5º.
Notwithstanding the first four paragraphs, the person responsible for a livestock operation piling solid manure in a cultivated field shall avoid any discharge of manure, liquid manure or contaminated water into any protected watercourse, water supply point, ditch, water reserve for fire fighting or the underground water table and take all measures required for that purpose.

36. Compulsory cleaning out: Any manure storage site must be cleaned out and the manure disposed of in accordance with Division VI so that the person responsible for the livestock operation has access to the storage capacity prescribed in section 30 where there are ground conditions as described in section 42.

37. Transport of manure: Any manure, liquid manure or contaminated water transported on a public thoroughfare shall be in a watertight container or vehicle.

DIVISION VI
MANURE DISPOSAL AND USE
38. Prohibited disposal methods: Any disposal of manure in lagoons is prohibited.

39. Frequency: Manure from a livestock operation shall be spread at least once a year on cultivated, grazing or uncultivated herbaceous land.
The operator of the livestock operation shall keep a record of spreadings indicating the date, place and quantity of manure spread on any land he does not own. He shall preserve such record for 2 years.
However, where a manure management organization approved by the Minister takes charge of the manure, the organization shall keep the record of spreadings indicating, in particular, the volume and type of manure spread, the origin and destination of the manure, the cadastral number of the lots where the manure is spread, the type of crops grown on those lots and the number of hectares devoted to those crops, the date of each spreading, as well as an evaluation of agronomic efficiency. The organization shall preserve such record for 2 years.

40. Spreading area: The person responsible for a livestock operation shall ensure that any manure from such operation is evenly spread, in accordance with section 39, without exceeding the maximum annual amount specified in Schedule F according to the type of culture.
The spreading area required under the first paragraph shall belong to the person responsible for the livestock operation, be rented to him in writing by a third party, or belong to a third party who agrees in writing to carry out the spreading himself or permits the person responsible for the livestock operation to do so.
Where the manure is spread on the land of a third person in accordance with the second paragraph, the person responsible for the livestock operation must have the documents referred to in that paragraph at all times. Section 21 applies to those documents mutatis mutandis.
Where a manure management organization approved by the Minister takes charge of the manure, the organization shall ensure that the manure in its charge is evenly spread, in accordance with the provisions of section 39, without exceeding the maximum annual quantity specified in Schedule F according to the type of crops. The organization shall also ensure that the liquid manure in its charge and resulting from the installations and activities covered by a project mentioned in section 10 is actually spread outside the municipalities listed in Schedule G, or that its equivalent in fertilizers in the form of azote or phosphor and made up of other manure is spread outside those municipalities.
Furthermore, the organization shall at all times have in its possession spreading agreements and it shall ensure that the same area is not the subject of more than one agreement at the same time.

42. Frozen or snow-covered ground: No manure shall be spread on frozen or snow-covered ground except where it is buried directly in the ground in compliance with section 40.

43. Proximity of water: No manure shall be spread in water or on ground, less than 30 metres from a protected watercourse, well or spring supplying a waterworks system, or water bottling plant or on ground less than 5 metres from another water supply point, an uncultivated ditch that is not regulated by municipal authority or a water reserve for fire fighting, or in such a way that it runs off towards any such point.

44. Manure spreading equipment: Where manure from a livestock operation is disposed of by spreading, the person responsible for the operation shall ensure that he has all the equipment necessary to spread manure in accordance with this Division, depending on the time spreading can be carried out and the distance to be travelled for such spreading.

45. Protection from runoff: A yard must be designed in such a way as to be protected from runoff.

Interception of runoff: Liquid manure and contaminated water from a yard shall be intercepted and channeled to a watertight holding tank constructed in compliance with the siting standards prescribed by Division V, unless, following treatment, they are no longer contaminants under section 20 of the Act.

FINAL PROVISIONS
47. Application of the Regulation: Sections 24 to 30, 32 and 34 do not apply to existing solid-manure livestock operations located outside the territories of municipalities listed in Schedule E, except for any expansion, increase in the number of animal units or change in the type of livestock.
A person responsible for a livestock operation entitled to the exception prescribed by the first paragraph shall avoid any discharge of manure, liquid manure or contaminated water into any protected watercourse, water supply point, ditch, water reserve for fire fighting or the underground water table and take all measures required for that purpose.

Exclusions: Sections 54 to 56 and 58 to 64 of the Act do not apply to methods of disposal, transport, storage, treatment and final deposit of manure governed by this Regulation nor to moveable or immoveable property used for those purposes.
