This Act regulates the return of unlawfully expropriated land to former owners or their legal successors and provides for compensation where land is not returned. It specifies who is entitled to claim return or compensation and establishes the cases in which land is returned in full, in part, or not returned, including situations where land is retained in state ownership or transferred into municipal ownership. The Act sets out rules for the return of land, including determination of boundaries, formation of cadastral units, and adjustment of land areas in accordance with planning and land consolidation requirements. It regulates cases in which land cannot be returned due to the existence of buildings, use by other persons, or other legal conditions, and provides for arrangements such as transfer of construction works, constitution of superficies, establishment of usufruct, or other agreements. The Act regulates the handling of land that is not returned, including its privatisation, retention in state ownership, or transfer into municipal ownership. It provides for procedures for privatisation, including privatisation by right of pre-emption and by auction, and for the establishment of usufruct on certain land. It also sets rules for determining land to be retained by the state and land to be transferred to local governments. The Act establishes the procedures for carrying out land reform, including decisions by local governments, cadastral procedures, registration of land and rights, and the implementation of land consolidation and allocation of land parcels. It also regulates the roles of the authorities responsible for carrying out land reform and the procedures required for completing land reform measures.
