The Act consists of 49 sections completed by three Schedules. The sections are divided into 5 Chapters: Conditions of cleanliness and order (I); Export of butter (II); Registration of premises (III): National mark for butter (IV): Miscellaneous and general (V). Premises for the production of dairy products for sale shall comply with conditions of cleanliness and order as set out in section 3. Any inspector (subject to the production by him if so required of his authority in writing as such inspector) may at all reasonable times enter any premises upon which dairy produce is manufactured for inspection (sect. 4). Any person on whom a notice of compliance is served by an inspector under this Part of this Act shall be entitled to have such notice referred in the prescribed manner to the arbitrator appointed under section 5. The Minister may, by order, make regulations in regard to the practice and procedure generally in relation to references to the arbitrator (sect. 8). Subject to the exceptions mentioned in section 9, all butter exported from Saorstát Eireann shall be exported only from premises registered in the register of creameries, or the register of manufacturing exporters, or the register of butter factories, or the register of non-manufacturing exporters and shall comply with the prescribed conditions. Sections 10 and 11 provide for the inspection and examination of butter intended for export, whereas section 12 provides for export licences. The Minister shall cause to be kept various registers for creamery and butter businesses (sect. 14). Conditions of registration are set out in section 15. Section 16 contains regulations applicable to registered creameries. Section 29 contains rules as to marking butter and packages. Regulations as to pasteurising are laid down in section 30. Section 35 provides for the establishment of national mark for butter. Subject to the provisions of any legislation already in force or hereafter to be passed in relation to trade marks or designs, every licence to use the national mark granted by the Minister shall, unless previously revoked under this section, continue in force so long as the premises in respect of which the licence is granted continue to be authorized premises.
