This Act consists of 81 sections divided into 7 parts. It creates a Drainage Council (sect. 2) which is responsible for receiving and evaluating petitions for the establishment of drainage districts. On its recommendation, the Minister responsible for the Environment decides on the establishment of the district. Changes to districts and their dissolution are also regulated (sects. 9-12). Each drainage district is governed by a Board of Trustees; the Act contains provisions on the composition and operation of the boards (sect. 14-29). For the purpose of carrying out their functions under the Act, the boards have the rights, powers and privileges of a natural person (sect. 17). Boards may construct, replace, extend, alter, modify, dismantle, abandon, operate and maintain drainage works (sect. 30). Boards have the power to determine and collect assessments and drainage rates for all the land in a drainage district (sect. 37-62). Appeals against the decisions of boards are regulated under part 5 (sect. 63-66).
