These Regulations set out restrictions on the export of kiwifruit (otherwise than for consumption in Australia) and provide for the Zespri Group to be the only exporter of kiwifruit as authorized by the New Zealand Kiwifruit Board. The Regulations further prescribe measures to mitigate the potential costs and risks arising from this market form in which only one buyer faces many sellers. The Regulations further determine collaborative marketing applications for the purpose of increasing the overall wealth of New Zealand kiwifruit suppliers and provide for the establishment of the New Zealand Kiwifruit Board.
