The present Regulation is made under the Responsible Energy Development Act. In particular, the Regulation lays down provisions considering whether an energy resource activity is in the public interest when conducting a hearing, inquiry or investigation. Section 3 of the Regulation states that for the purposes of section 15 of the afore-mentioned Act, when the Regulator is to consider an application or conduct a regulatory appeal, reconsideration or inquiry in respect of an energy resource activity under an “energy resource enactment”, the Regulator shall take into account: a) the social and economic effects of the energy resource activity; and b) the effects of the energy resource activity on the environment.
