This Part of Division 6 of the Fish and Game Code of California sets out general policies for the management and conservation of marine fisheries resources in the State of California and provides with respect to marine fisheries generally. More specifically, it also concerns fisheries management plans, the Fish and Game Commission and the Department of Fish and Game and fisheries science. The Chapter defines the policy of the State in respect of the conservation, sustainable use and restoration of California’s marine living resources, protection of (diversity of) marine ecosystems, and collaboration with adjacent states, as well as with Mexico and Canada. The growth of commercial fisheries, including distant-water fisheries, shall be encouraged. Any fishery management regulation adopted by the Commission shall, to the extent practicable, conform to the policies set out in this Part. The Director of Fish and Game shall report annually in writing to the Commission on the status of sport and commercial marine fisheries managed by the state. Fishery management plans shall form the primary basis for managing California’s sport and commercial marine fisheries. Fishery management plans shall be prepared by the Department and adopted by the Commission. Programs for the conservation and management of the marine fishery resources of California shall be established and administered to prevent overfishing, to rebuild depressed stocks, to ensure conservation, to facilitate long-term protection and, where feasible, restoration of marine fishery habitats, and to achieve the sustainable use of the state’s fishery resources. Each fishery management plan and plan amendment shall include a list of any statutes and regulations that shall become inoperative, as to the particular fishery covered by the fishery management plan or plan amendment, upon the commission’s adoption of implementing regulations for that fishery management plan or plan amendment.
