This Resolution establishes general criteria for granting the right for water resources use. It specifies that granting does not imply total or partial alienation of inalienable waters, but the simple right to use. The concession confers the right to use water resources subject to water availability. The granting should consider the interdependence of surface and groundwater and the interactions observed in the hydrological cycle aiming at the integrated management of water resources. The transfer of the granting act to third parties shall retain the same characteristics and conditions of the original one. Specific criteria for accumulation of water volumes considered to be insignificant shall be established in the water resources plans, duly approved by the relevant river basin committees or, in the absence thereof, by the granting authority. The granting of the right to use water resources will have a maximum term of thirty-five years, from the date of publication of the respective administrative act, subject to the following deadlines: up to two years, to commence implementation of the project being granted; up to six years, to complete the implementation of the project.
