Legislative Decree No. 136/2022 constitutes a normative instrument aimed at harmonizing Italy’s domestic legal framework with the provisions of Regulation (EU) 2016/429 concerning transmissible animal diseases. The Decree is enacted pursuant to Article 14, paragraph 2, of Law No. 53 of 22 April 2021, and addresses multiple legislative mandates therein, specifically those under letters a), b), e), f), h), i), l), n), o), and p). The decree entrusts the Ministry of Health with the role of central veterinary authority, thereby conferring upon it the responsibility for coordinating official controls in the domain of animal health and welfare. This includes oversight of disease surveillance, implementation of control and eradication measures, and the enforcement of obligations incumbent upon operators and establishments involved in the keeping, transport, or trade of animals and germinal products. In alignment with the EU Regulation, the Decree delineates the procedural and substantive obligations of stakeholders, including the registration of operators and establishments, the traceability of animals, and the notification of disease outbreaks. It also establishes mechanisms for the recognition of disease-free status, the imposition of emergency measures, and the regulation of intra-Union and third-country trade in animals and animal products.
