This Model Law establishes a comprehensive legal framework governing relations between consumers and businesses in the purchase of goods, works, and services. The Law defines key concepts such as consumer, producer, seller, importer, and defects, and outlines its objectives: ensuring access to safe and quality goods and services, promoting fair pricing and competition, and enhancing international cooperation. It regulates consumer contracts and seeks to protect consumers from unfair business practices while promoting economic efficiency and transparency. The Law sets out a broad catalogue of fundamental consumer rights, including access to essential goods and services, safety of products, protection of economic interests, and the right to reliable information necessary for informed decision-making. It requires businesses to provide detailed information about products and services, ensure safety standards, and avoid unfair contractual terms or misleading practices. It also guarantees rights to consumer education, data protection, dispute resolution, and the formation of consumer organizations. Special attention is given to vulnerable groups such as minors, persons with disabilities, and the elderly, ensuring accessibility, protection against exploitation, and tailored safeguards in areas such as finance and digital services. In addition, the Law provides detailed rules on the protection of consumers in specific sectors, including retail trade, services, e-commerce, financial services, healthcare, utilities, transport, and tourism. It establishes mechanisms for enforcement, including liability for damages, compensation (including moral damages), and penalties for violations. Consumers are granted access to judicial and alternative dispute resolution procedures, with procedural advantages such as exemption from court fees and flexible jurisdiction rules. The Law also regulates state oversight, public consumer associations, and cross-border issues, making it a comprehensive model framework for harmonizing consumer protection legislation across CIS member states.
