This Recommendation adopts implementing rules for the process of identification of cases of non-compliance with or lack of cooperation on GFCM conservation and management measures by the contracting parties and cooperating non-contracting parties (CPCs) and appropriate measures to deter non-compliance, as referred to in paragraphs 1 and 5 b) of Recommendation GFCM/38/2014/2 concerning the identification of non-compliance. The GFCM Secretariat shall produce a compliance assessment scheme for each contracting party and cooperating non-contracting party (CPC) concerned. The scheme shall include, for each individual case of non-compliance, a categorization and evaluation of its severity, based on the criteria listed in Annex 1. The compliance with GFCM decisions of each CPC shall be reviewed by the Compliance Committee (CoC) on the basis of the compliance assessment scheme. Each year, the CoC shall determine the appropriate measures addressing each individual case of non-compliance depending on its type and level of severity as described in Annex 2.
