This Order establishes Denmark’s extended producer responsibility scheme for certain single-use plastic products, covering food containers, packets and wrappers, beverage containers, cups, lightweight plastic carrier bags, wet wipes, balloons, and filters for tobacco products. It requires producers, including certain distance sellers, to register in the digital producer register administered by Dansk Producentansvar, report quarterly the quantities and categories of covered products placed on the Danish market, keep records, and pay fees to finance public clean-up of litter, collection of waste discarded in public collection systems, subsequent transport and treatment, public information measures, data collection, reporting and scheme administration. The Order also regulates representatives for foreign or cross-border sales, collective schemes, self-monitoring by producers and collective schemes, administrative cooperation and data exchange between Dansk Producentansvar, the Danish Environmental Protection Agency, other EU authorities and the Commission, supervision, complaints, penalties and possible imprisonment for serious intentional or grossly negligent breaches causing environmental harm or economic gain. It implements parts of Directive (EU) 2019/904 on reducing the environmental impact of certain plastic products.
