Order No. 500 on the fee scheme for compensatory nature in designated acceleration areas.

This Order establishes a fee-based scheme for compensatory nature measures in designated acceleration areas for renewable energy projects. Where a project approval determines that a renewable energy development is likely to cause significant unavoidable adverse effects on protected species and their habitats, and suitable mitigation or compensation measures cannot be implemented by the project owner, the project owner must pay both an initial establishment fee and an ongoing annual fee. The fees finance the creation and maintenance of compensatory habitat by the Danish authorities on an area equivalent to 150% of the affected project area, with the aim of safeguarding or improving the conservation status of the affected protected plant and animal species. The regulation sets out how fees are calculated, adjusted and collected, assigns administrative responsibilities to the relevant authorities, provides appeal procedures, and establishes penalties for non-payment.
