The Legislative Decree No. 30/2026 implements Directive (EU) 2024/825 on empowering consumers for the green transition by strengthening protection against unfair commercial practices and improving consumer information. The decree amends the Italian Consumer Code to introduce new definitions relating to environmental claims, sustainability labels, certification schemes, durability, repairability, software updates and products with digital elements. It aims to improve the reliability and transparency of environmental and sustainability-related information provided to consumers and to prevent misleading commercial practices associated with green marketing. The Decree expands the rules on unfair commercial practices by prohibiting unsupported generic environmental claims, misleading sustainability labels, unsubstantiated claims concerning future environmental performance, and assertions of climate neutrality based solely on emissions offsetting. It also introduces provisions addressing planned obsolescence and product durability, including misleading statements on product lifespan, repairability, software updates and replacement of consumable components. Additional obligations require traders to provide clearer information on environmental characteristics, durability guarantees, software update periods, repair options, spare parts availability and repairability indicators. The legislation strengthens consumer rights by requiring harmonised notices on legal conformity guarantees and harmonised labels for commercial durability guarantees. It introduces enhanced pre-contractual information obligations for distance and off-premises contracts, including disclosure of repairability, software support and post-sale services.
