Rules and Regulations implementing Republic Act No. 10945: An Act Establishing a Multi-Species Marine Hatchery in the Municipality of Perez, Province of Quezon and Appropriating Funds Therefor.

These Implementing Rules and Regulations implement Republic Act No. 10945 establishing a Multi-Species Marine Hatchery (MSMH) in the Municipality of Perez, Province of Quezon. They define the institutional, operational and management arrangements for the hatchery, including provisions on construction, commissioning, operation and the phased transfer of management from the Department of Agriculture, through the Bureau of Fisheries and Aquatic Resources (DA-BFAR), to the local government unit (LGU). The Rules assign responsibility to DA-BFAR Regional Fisheries Office IV-A for supervising construction, funding and operating the hatchery during the initial period, providing training and technical assistance to LGU personnel, and implementing a phasing-in programme to facilitate the transfer of operations. The LGU is required to establish plantilla positions for hatchery personnel, allocate local funds for hatchery operations, and maintain a trust fund account for revenues generated by the facility. The Rules further establish a Monitoring Committee responsible for monitoring implementation, conducting consultations and submitting reports to DA-BFAR and the LGU. They also authorize DA-BFAR to issue supplementary circulars and memoranda and include provisions on amendment, suspension or revocation of the Rules, separability and effectivity.
