Order No. 358/2025/1 establishing the requirements for applying to production and operating licenses for biomass power plants.

This Order establishes the procedural requirements for obtaining production and operating licences for new forest biomass power plants under the special regime created by Decree-Law No. 64/2017. Its primary objective is to implement the licensing framework for biomass energy facilities intended to support forest management, preservation and protection, while contributing to the prevention of rural wildfires through the valorisation of residual forest biomass. The regulation specifies the documentation that developers must submit to the Directorate-General for Energy and Geology (DGEG) and to the Institute for Nature Conservation and Forests (ICNF), including environmental authorisations, sustainability assessments and information relating to biomass resource availability. The regulation further aims to ensure the sustainable supply and monitoring of biomass resources by requiring long-term projections of biomass sourcing, measures for supply-chain development, cooperation with local authorities and forestry stakeholders, and systems for tracking the origin and quantities of biomass used. In addition, it establishes the procedures governing operating licences and requests for exemption from mandatory carbon capture and utilisation systems, including the technical and economic criteria to be assessed.
