This Decree regulates the Environmental Regularisation Programme (PRA) for rural properties in the State of São Paulo, implementing the provisions of Federal Law No. 12.651 of 2012 (Forest Code) and State Law No. 15.684 of 2015. It establishes the procedures through which rural landowners and possessors may regularise environmental liabilities, particularly those related to Permanent Preservation Areas (APPs) and Legal Reserves, through the submission of a Project for the Restoration of Degraded and Altered Areas (PRADA) and the execution of a commitment agreement setting out restoration obligations and implementation schedules. The decree defines the rules governing environmental restoration and compensation measures. It establishes criteria for the recomposition and compensation of Legal Reserves, prioritises the inclusion of existing native vegetation within Legal Reserves, and requires that environmental regularisation be carried out in a manner that balances environmental protection with the social and economic viability of rural properties. The decree also permits the use of state environmental restoration programmes, such as the Programa Nascentes, to implement restoration obligations and provides specific rules for relocating Legal Reserves when environmental gains can be demonstrated.
