This Implementing Rules and Regulations (IRR) implements Republic Act No. 10944, which establishes a Multi-Species Marine Hatchery (MSMH) in the Municipality of Hinatuan, Surigao del Sur. The IRR designates the Department of Agriculture, through the Bureau of Fisheries and Aquatic Resources (DA-BFAR) Regional Fisheries Office XIII, as the supervising authority responsible for overseeing construction, funding the initial operational phase, and providing training and capacity-building support for local personnel. It requires that the hatchery be constructed and operated in accordance with an approved feasibility study and detailed engineering design, and mandates the transfer of management and operation of the facility to the local government unit within two years after construction and commissioning. The regulations further establish monitoring and reporting mechanisms, require the LGU to create permanent staffing positions and allocate financial resources for hatchery operations, and provide for the exclusive use of hatchery proceeds for fisheries development, operation, and related capacity-building activities.
