Decree No. 11.728 amending Decree No. 11.368 implementing Law No. 3.724 on the animal health protection in the State of Acre, to provide for the issuance of a warning notice.

This Decree amends Decree No. 11.368 regulating the State of Acre’s animal health legislation, with the principal objective of introducing and regulating the use of a formal Warning Notice (Auto de Advertência) as an alternative administrative measure to an Infraction Notice in cases of lesser severity. The amendment seeks to promote a more proportionate enforcement approach by allowing the conversion of an Infraction Notice into a Warning Notice when the offender has not acted with intent or bad faith, is a first-time offender who has not been sanctioned within the previous two years, and has committed an offence considered to have a low harmful potential, reflected by a relatively small financial penalty. The Decree further aims to enhance administrative efficiency in the enforcement of animal health regulations by authorising officials of the Institute for Agricultural and Forestry Defence of Acre (IDAF) to issue a Warning Notice directly at the time of inspection whenever the prescribed conditions are met. In addition, it revokes specific provisions of the 2023 Decree that previously governed related procedures, thereby consolidating the new warning mechanism within the regulatory framework. The measure entered into force on the date of its publication and is intended to improve the proportionality, effectiveness and educational character of animal sanitary enforcement actions in the State of Acre.
