The present Order makes provisions for the prospecting of biological and genetic resources, in order to assure their management and conservation, as well as their rational exploitation. The Order first considers the different governmental departments and agencies involved, inter alia, in the promotion of the national development or in the formulation and implementation of the relevant programs and policies. The prospecting of biological and genetic resources is subject to a Research Agreement between the Government, represented by the departments or agencies concerned, and the person, entity or corporation, depending on the nature and character of the prospecting activity. If the research and collection of biological and genetic resources is intended for commercial purposes, the agreement will be a Commercial Research Agreement. Further provisions concern the procedure to be followed in order to enter into said agreements. Section 6 concerns the creation of the Inter-Agency Committee on Biological and Genetic Resources, whose functions are relevant to the implementation and enforcement of the provisions of the present Order.
