The Governor, for the purpose of regulating activity of legal persons and individual entrepreneurs carrying out industrial fisheries and fish farming in the inland waters, territorial sea and continental (freshwater) water bodies, decrees to validate the Provisional Regulation. The distribution of quotas for aquatic biological resources shall be carried out with the consideration of the following factors: 1) possession by the user of licences for industrial fisheries, catch of aquatic animals and harvest of aquatic plants and availability of copies of licences for fishing vessels; 2) composition and fishing capacity of small size fishing vessels; 3) availability of fishing areas assigned to the users and of the respective fishing gear; 4) the results of the use of fishing quotas for catch of aquatic biological resources for the previous year and for the first half of the current year; 5) delivery of catch to the coastal fish processing enterprises; 6) availability of the proper fish processing enterprises; 7) participation in the arrangements for stock enhancement of aquatic biological resources; 8) absence of violations of the Fisheries Regulations. Scanty indigenous population living in compact settlements shall have priority to allocation of quotas for catch of marketable fishes for proper consumption. Total allowable catch of aquatic invertebrates populating fishing areas shall be distributed among the aforesaid fishing areas or, taking into consideration biological particulars thereof, within the boundaries of defined marine zones that can comprise more than one fishing area.
