This Law makes provision for the protection of the environment, the prevention of pollution and the management of waste in Guernsey. The primary objective of this Law is to ensure that activities which may give rise to a risk of environmental pollution are only carried on in the interest of the community using the best available technology. The States may, by Ordinance, enact such provisions as they consider expedient in relation to environmental pollution and shall appoint a Director of Environmental Health and Pollution Regulation. The Director shall, among other things, decide on application for licences for operations as may be prescribed by the States. Appeal against decisions may be had with the Environmental and Public Health Appeals Panel to be established by the States. The States shall also designate a person or a committee as the Waste Disposal Authority, which shall carry out the functions conferred on it as respects the management of waste by or under this Law or any other enactment. The Law, furthermore, provides rules relating to, among other things, disposal of private waste on land, waste disposal from land to sea, licensing of waste operations, prevention of water pollution, protection of catchment areas, discharges from vessels and prevention of air pollution.
