Offshore Electricity Infrastructure Act 2021 (No. 120, 2021).

The Offshore Electricity Infrastructure Act 2021 establishes a comprehensive legal framework for the regulation of offshore electricity infrastructure in Australia's Commonwealth offshore area. The object of this Act is to provide an effective regulatory framework for offshore renewable energy infrastructure; and offshore electricity transmission infrastructure. The Act defines key terms such as offshore renewable energy infrastructure and offshore electricity transmission infrastructure, and outlines the scope of activities permitted under the legislation. It prohibits any offshore infrastructure activity without a valid licence and empowers the Minister to declare specific areas suitable for such activities. These declared areas are selected based on compatibility with existing marine uses, and licence holders are responsible for managing interactions within them. A structured licensing scheme is central to the Act. It includes feasibility licences for preliminary investigations, commercial licences for full-scale operations, research and demonstration licences for experimental technologies, and transmission and infrastructure licences for connecting offshore generation to onshore grids. Each licence type has specific conditions, merit criteria, and terms, with provisions for extension, variation, and transfer. The Act also establishes regulatory bodies, including the Offshore Infrastructure Registrar and the Offshore Infrastructure Regulator, to oversee licensing, compliance, and enforcement.
