This Law on Administrative Procedures establishes the fundamental principles, scope, and framework for resolving administrative disputes in Vietnam. It defines the rights and obligations of individuals, organizations, procedure-conducting agencies, and courts in administrative proceedings. The Law covers the institution of lawsuits, settlement of administrative cases, execution of administrative judgments, and the handling of complaints and denunciations. It aims to safeguard justice, protect human and citizens’ rights, ensure lawful administration, and promote transparency, fairness, and equality before the law in all administrative procedures. It applies to administrative activities within Vietnam’s territory and to Vietnamese missions abroad. The Law sets out detailed rules on parties involved in administrative cases—plaintiffs, defendants, and related persons—and regulates the burden of proof, evidence, provisional urgent measures, and procedural rights such as dialogue, appeal, and legal aid. It establishes court jurisdiction at district and provincial levels and outlines the duties and powers of judges, procurators, clerks, and assessors to ensure impartiality, independence, and proper legal supervision.
