Directive 2014/25/EU on procurement by entities operating in the water, energy, transport and postal services sectors and repealing Directive 2004/17/EC.

This Directive sets out the rules for procurement procedures by contracting entities for contracts and design contests above specified thresholds. It defines procurement as the acquisition of works, supplies, or services through contracts with selected economic operators for activities outlined in Articles 8 to 14, subject to Article 346 of the TFEU. The Directive respects Member States’ freedom to determine and organize services of general economic interest, including their financing and obligations, as well as decisions on performing public functions themselves under Article 14 and Protocol No. 26. It does not interfere with the organization of social security systems and excludes non-economic services of general interest from its scope.
