The Water Byelaws (Guernsey) Ordinance, 2003 establishes a regulatory framework governing the installation, use, and maintenance of water fittings supplied by the States’ Trading Supervisory Board. It repeals Waterworks Byelaws Ordinance, 1948 and Waterworks Byelaws (Amendment) Ordinances of 1954, 1956, and 1976. The byelaws apply to water systems connected to the public supply and impose mandatory standards to prevent waste, misuse, undue consumption, contamination, and inaccurate metering. Installations must meet prescribed technical specifications, conform to recognised standards, and be executed in a workmanlike manner. Prior notification and consent are required for specified works, subject to deemed approval where no response is issued within a statutory period. Provisions regulate system design, materials, backflow prevention, and operational safety, including requirements for cold and hot water systems, storage, pressure control, and sanitation appliances. The framework categorises fluids by health risk and mandates corresponding protective measures to safeguard potable water integrity. Enforcement powers are vested in the supervisory authority, including inspection, testing, and sampling rights. Non-compliance constitutes an offence subject to summary conviction and financial penalty, with limited statutory defences available where certified work is undertaken by approved contractors.
