These Implementing Rules and Regulations, issued by the Department of Agriculture's Bureau of Fisheries and Aquatic Resources (DA-BFAR) pursuant to Republic Act No. 10856, provide the framework for the establishment, operation, management, monitoring and eventual transfer of the Multi-Species Marine Hatchery in the Municipality of Bantayan, Cebu. The Rules assign DA-BFAR RFO VII responsibility for supervising construction and initial operations, funding activities, and implementing a two-year training and phasing-in programme for local government personnel. They regulate the transfer of hatchery management to the Municipality of Bantayan through a Memorandum of Agreement and require the local government unit to create permanent positions and establish a trust fund to support hatchery operations and development. The Rules also establish a monitoring mechanism through a DA-BFAR Monitoring Committee and provide for continued technical assistance by DA-BFAR following the transfer. Further provisions concern implementation, amendment, publication and effectivity of the Regulations.
