Decree No. 69.903 establishing the State Programme for Ecological Restoration and Conservation, through the procurement of environmental services, in Nature Conservation Areas and other areas forming part of the State Forestry System (SIEFLOR), as well as in other public areas of environmental interest.

This Decree establishes the State Programme for Ecological Restoration and Conservation under the coordination of the São Paulo State Secretariat for the Environment, Infrastructure and Logistics. The Programme provides for the contracting of environmental services in nature conservation units, other areas forming part of the State Forest System (SIEFLOR), and other publicly owned areas of environmental interest. Its principal objectives are to maximise ecological restoration and conservation, enhance the value of ecosystem services relating to ecosystems, water resources, climate regulation, soil and biodiversity, align State action with global climate-neutrality goals, and contribute to the restoration and negative-emissions targets established under São Paulo’s climate action, adaptation and resilience plans. It also seeks to provide technical guidance for large-scale restoration and conservation measures and to attract private investment through long-term legal instruments offering legal certainty. The Decree permits remuneration for environmental services through established payment mechanisms, including the transfer of carbon credits, biodiversity credits and other environmental assets generated in the intervention areas. Contracts must identify the relevant areas, ecological targets, deadlines, evaluation criteria, remuneration arrangements, the parties’ rights and obligations, risk allocation and consequences of partial or total non-performance. Service providers must be selected through a specific competitive procedure. The Forest Conservation and Production Foundation is authorised to support implementation in SIEFLOR areas by commissioning technical studies, supervising services, measuring restoration and conservation outcomes, and monitoring the Programme’s impacts.
