These Regulations apply to seed produced in England as part of a temporary experiment. The goal of the experiment is to explore alternative certification requirements for CMS wheat hybrids (as defined in regulation 2), which fall under the basic or certified seed categories outlined in regulation 5 of the Seed Marketing Regulations 2011 (S.I. 2011/463) (“the 2011 Regulations”). The aim is to identify certification standards that are more suitable than those currently specified in the 2011 Regulations. The experiment will take place over a 7-year period, starting on 26th September 2024. Licences issued under regulation 3(3) of these Regulations exempt participants from complying with certain provisions of the 2011 Regulations, which currently prevent CMS wheat hybrids from being certified due to conditions they cannot meet. Regulations 7 and 8 give the Secretary of State the authority to alter, suspend, or revoke a licence granted under regulation 3(3) in certain situations. Regulations 9 to 11 outline the reporting and record-keeping obligations for participants. Regulation 12 explains the process for applying for certification of CMS hybrid seeds developed under these Regulations. Paragraph 7 of the Schedule modifies the appeal rights under the 2011 Regulations.
