The Legislative Decree No. 190/2024 establishes the administrative regimes for the production of energy from renewable sources, in implementation of Article 26, paragraphs 4 and 5, letters b) and d), of Law No. 118/2022. The decree defines the administrative regimes for the construction and operation of renewable energy production plants, including modifications, enhancements, and partial or total reconstructions, as well as the necessary connected works and infrastructures. It ensures the maximum dissemination of renewable energy plants through the rationalization, reorganization, and simplification of procedures, aligning with EU regulations while respecting environmental, biodiversity, and ecosystem protection, as well as cultural heritage and landscape. The decree mandates that regions and local authorities comply with its principles within 180 days of its entry into force, with the previous regulations remaining applicable in the interim. The decree also outlines the general principles, including public utility, urgency, and the administrative regimes applicable to the realization of renewable energy projects, ensuring procedural speed, uniformity, and non-aggravation of burdens, while promoting transparency, competition, and public participation. The decree further specifies the conditions under which renewable energy projects are considered of overriding public interest, subject to environmental compatibility assessments, and defines the administrative procedures for the realization of such projects, including simplified and unified authorization processes.
