First Nations Voice Act 2023.

The First Nations Voice Act 2023 establishes a legislative framework in South Australia to ensure that Aboriginal and Torres Strait Islander peoples have a formal and recognised voice in the decisions that affect their lives. It creates two key representative structures: Local First Nations Voices and the State First Nations Voice, both designed to operate independently of government control. Local First Nations Voices are regionally based bodies composed of elected members who reflect gender diversity and are tasked with representing the views of First Nations people in their respective areas. These bodies can engage with public sector agencies, local governments, and other organisations to influence policies and procedures. They also liaise with the State First Nations Voice to ensure regional concerns are elevated to the state level. The State First Nations Voice is composed of joint presiding members from each Local First Nations Voice. It serves as the central body for representing First Nations perspectives to the South Australian Parliament and Government. It has the authority to address Parliament annually, respond to Bills, and present reports on matters of interest. It also engages directly with Cabinet, Chief Executives of administrative units, and Ministers through structured meetings and hearings. The Act outlines detailed procedures for elections, including eligibility criteria, nomination processes, voting systems, and dispute resolution mechanisms. It mandates the establishment of advisory committees focused on elders, youth, stolen generations, and native title bodies, ensuring diverse representation and input. Administrative support is provided through a secretariat, and the Minister is responsible for determining appropriate resources after consultation. The Act includes provisions for confidentiality, protection from obstruction, and legal immunities for members acting in good faith. It also amends the Constitution Act 1934 to formally recognise the importance of First Nations voices in South Australia’s governance.
