Implementing Rules and Regulations Pursuant to Republic Act No. 10787: An Act Establishing a Multi-Species Marine Hatchery in the Municipality of Lingig, Province of Surigao del Sur and Appropriating Funds Therefor.

This Implementing Rules and Regulations (IRR) gives effect to Republic Act No. 10787, which establishes a Multi-Species Marine Hatchery (MSMH) in the Municipality of Lingig, Province of Surigao del Sur. The Regulations designate the Department of Agriculture, through the Bureau of Fisheries and Aquatic Resources (DA-BFAR) Regional Fisheries Office XIII, as the authority responsible for the hatchery's design, construction, supervision and initial operation. They provide for the preparation of feasibility studies and engineering plans, funding and operational support by DA-BFAR, and the implementation of training and capacity-building programmes for local personnel. The IRR requires the transfer of management and operation of the hatchery to the Local Government Unit of Lingig within two years of commissioning through a Memorandum of Agreement, establishes staffing and operational requirements, and creates a monitoring mechanism to oversee implementation. Financial provisions require the allocation of local funds and the establishment of a trust fund to support hatchery operations, while DA-BFAR remains responsible for providing technical assistance after the transfer of management.
