Decree No. 11.788 regulating the State Programme for Government Procurement from Family Farming and the Solidarity Economy in the State of Acre – PECAFES, established by Law No. 4.516.

This Decree regulates State Law No. 4.516 of 3 January 2025, which established the State Government Procurement Programme for Family Farming and the Solidarity Economy (PECAFES) in the State of Acre. Its principal objective is to create a legal and administrative framework for the accreditation, qualification, selection and contracting of family farmers, rural producers and nurseries to supply seedlings, seeds, plant inputs and other agricultural products to public bodies. The Decree assigns responsibilities to the State Secretariat of Agriculture (SEAGRI), establishes procedures for public calls for accreditation, and seeks to ensure transparent, fair and organised access by eligible producers to government procurement opportunities. The Decree also aims to guarantee that suppliers meet the necessary technical, legal, fiscal, environmental and phytosanitary requirements before being contracted by the State. It establishes rules governing documentation, eligibility verification, selection criteria, contract management and official oversight, including the possibility of inspections throughout production, transport and delivery stages. In addition, the 2026 amendment introduces a mandatory review of qualification documents by the Secretariat for Procurement, Bidding and Contracts (SELIC), thereby strengthening compliance and administrative control within the procurement process. Overall, the measure promotes local agricultural production, supports family farming and the solidarity economy, and ensures the regular and transparent procurement of agricultural products by the State of Acre.
