Environmental Management and Protection Act, 2002 (S.S. 2002, c. E-10.21).

This Act consists of 85 sections divided into 9 Parts and constitutes the basic framework for the management and protection of the environment in Saskatchewan. The ministry of the environment is responsible for all matters not by law assigned to any other minister or government agency respecting the environment and enhancing and protecting the quality of the environment (sect. 3). Part III is dedicated to the protection against unauthorized discharges and pollution. All discharges of substances into the environment are subject to authorization and a remedial action plan is to be elaborated by any person directly responsible for the discharge. Section 15 is dedicated to issues of civil liability for discharges. Part IV deals with the protection of water and is organized in three divisions: regulation of water quality, drinking water and wastewater and permits respecting discharges into water and alterations to water bodies. Part V is dedicated to halocarbons and contains provisions, among others, on their collection, recycling and disposal. Part VI includes general rules respecting orders and permits under the Act, while Part VIII concerns offences, enforcement and administrative penalties. Part VII is dedicated to the administration of the Act and to the powers of environmental officers. Among others, environmental officers may perform inspections and may decide to seize, remove and detain any item or thing as the officer considers necessary to stop or prevent the creation of an adverse effect.
