Trade Mark Act (MarkenG).

The present Act lays down provisions relating to the protection of trade marks and designation of origin. Article 4 establishes that the protection of trademark is created by registration as a trade mark in the register kept by the Patent Office. The present Act consists of 165 articles divided into 9 Parts as follows: Sphere of application (1); Conditions, content and limits of protection of trademarks and trade name; transfer and licence (2); Procedures in trade mark matters (3); Collective marks (4); Protection of trademarks under the Madrid Agreement and the Protocol relating to the Madrid Agreement, Community trade marks (5); Geographical Indications (6); Procedures in disputes concerning marks (7); Penalties and fines; sequestration in import and export (8); Transitional provisions (9). The recent amendments are updating several procedural provisions to align with new EU regulations and giving the Federal Ministry of Justice and Consumer Protection broader authority to define detailed rules for trademark applications, oppositions, amendments, and compliance with the EU regulations on geographical indications.
