The present Regulation is made under section 12 of the Economic Development Act. Section 3 establishes that the Minister may grant financial assistance under subsection 3(1) of the Act to an industrial, commercial or business activity that is a mineral ore concentrating operation, whether the operation is conducted separately from or as a part of a mining operation.
