Law No. 105/2016 on plant protection.

This Law aims at protecting plants and plant products from parasites, preventing entrance and distribution of parasites to the Albanian territory, and protecting the health of humans, animals, and environment from the products used for plant protection. The Law consists of 7 Chapters: General Provisions (1); Organization and Functioning of the Plant Protection Entities (2); Parasites Control (3); Phytosanitary Inspection and Service (4); Plant Protection Products (5); Administrative Infringements (6); Final Provisions (7). The institutional framework for plant protection includes the line department in the Ministry of Agriculture, the National Food Authority, the regional plant protection service, the Institute of Food Safety and Veterinary (IFSV), and the Department of Plant Protection at IFSV. The operational scope of the Law encompasses strict quarantine measures, registration protocols for plant protection products, and comprehensive surveillance systems across agricultural land and borders. It establishes detailed duties for inspectors to sample, monitor, and detain non-compliant consignments, alongside mandating phytosanitary certificates for imported and exported vegetative materials. Additionally, the Law regulates the authorization, trade, storage, and safe disposal of chemical plant protection products to mitigate chemical residues in agricultural yields and lower ecological contamination risks. Furthermore, the Law lays down specific compliance requirements for growers, traders, and agricultural operators, enforcing reporting procedures for any suspected outbreaks of harmful organisms. It defines administrative violations, outlining exact fines and enforcement measures for illegal distribution of unauthorized pesticides or non-compliance with quarantine protocols.
