It is declared to be the policy of the Congress and the purpose of this chapter that it is essential and in the public interest to authorize and enable the establishment of an orderly procedure for the development and the financing through an adequate assessment, an effective and continuous coordinated program of research, consumer and producer education, and promotion designed to strengthen the egg industry's position in the marketplace, and maintain and expand domestic and foreign markets and uses for eggs, egg products, spent fowl, and products of spent fowl of the United States. Further, the Chapter enumerates the permissive terms and conditions in orders issued by the Secretary of Agriculture which regulate the advertising, sales promotion, and consumer education plans or projects, prohibition on reference to private brand or trade name and use of unfair or deceptive acts or practices. It also establishes an Egg Board responsible to administer such orders in accordance with their terms and provisions, to make rules and regulations to effectuate them, to receive, investigate and report to the Secretary complaints regarding order violations, and to recommend to the Secretary amendments to such orders. For the purpose of ascertaining whether the issuance of an order is approved or favored by the egg producers the Secretary shall conduct a referendum among egg producers and no order shall be effective unless the Secretary determines that the issuance of such order is approved or favored by not less than two-thirds of the producers voting in such referendum. This Act may be cited as the Egg and Consumer Information Act.
