These Measures are enacted in accordance with the Product Quality Law of the People's Republic of China, the Law of the People's Republic of China on the Protection of Consumers' Rights and Interests, for the purposes of strengthening the supervision and administration of product quality, regulating the supervisory spot checks on product quality, and protecting the lawful rights and interests of consumers. For the purposes of these Measures, “supervisory spot checks” means the activities organized by market regulatory departments in accordance with the law for the purpose of supervising product quality, including the sampling and inspection of the products produced and sold within the territory of the People's Republic of China, and the handling of results of supervisory spot checks. Supervisory spot checks are divided into national supervisory spot checks organized by the State Administration for Market Regulation (“SAMR”) and local supervisory spot checks organized by local market regulatory departments at or above the county level. The SAMR shall be responsible for making the annual plan for national supervisory spot checks, and notifying market regulatory departments at the provincial level. The rules for separating sampling from inspection shall be adopted for supervisory spot checks. Except for on-site inspection, sampling personnel shall not undertake the inspection of the sampled products.
